Terms of Service

These Terms cover how you and EMJAY747 Enterprises LLC agree to use the Next Inning app ("the App"). By creating an account, signing in, or using the App, you agree to them. If you do not agree, do not use the App. We've kept the language plain so a busy coach can actually read it.

The service

Next Inning is a youth baseball and softball coaching app that lets a coach plan lineups, run a dugout view, log game results, message their coaching staff, and share fairness reports with parents. The App is provided by EMJAY747 Enterprises LLC. We may add, change, or remove features over time.

Eligibility and coaching authority

You must be at least 18 years old to create an account. The App is intended for adults (coaches and team staff); it is not directed to children, and children may not create accounts.

If you enter information about a player who is a minor, you represent and warrant that you are that team's coach or authorized staff and that you have the authority and any necessary parental or guardian permission to provide that information for the purpose of managing the team. You agree to remove a player's information promptly if you no longer have that permission or if a parent or guardian asks you to. A parent or guardian may also contact us at support@nextinning.app to request removal.

Your account

You are responsible for the activity on your account and for the accuracy of the team and player information you enter. Sign-in uses a one-time code sent to your email; keep access to that email secure. You may invite assistant coaches with the invite-code feature and revoke their access from team settings at any time.

Acceptable use

You agree not to misuse the App. That includes:

Your data

You retain ownership of the team data you enter (rosters, games, fielding plans, notes, stats, and chat messages). You grant us a limited license to store, process, and display that data solely to provide the App to you and the assistant coaches you authorize. For team chat, that means storing and showing your messages to the coaches on your team so the chat works. We do not use your data for advertising and we do not sell it. You can delete your data and account at any time from Settings in the app; see our Privacy Policy for details.

Free access, future pricing, and no warranty

The App is currently provided free of charge.

Early access period. If you create your account on or before December 31, 2026, the features available to you during that period remain free of charge through December 31, 2027. We will not charge you for those features before January 1, 2028.

Accounts created on or after January 1, 2027 are not covered by that period and may be subject to paid subscription terms once those are introduced.

We may introduce paid features or subscriptions. If we do, we will show the price and the terms before you are asked to pay, and you will not be charged without your express confirmation through the app store you installed from.

If a paid subscription is introduced and you choose not to purchase it, the information you have entered is retained and is not deleted. Some features may stop being available to you until you subscribe. You may delete your account and its data at any time from Settings.

The App is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted or error-free, and lineup or fairness suggestions are aids for the coach's judgment, not a substitute for it.

Referral program

We may offer a referral program that lets you share a code with another coach. If someone creates a new account using your code, we credit your account with a discount toward a future paid subscription. The amount, the limit on how many referrals earn credit, and the conditions are shown in the app at the time you use the feature.

Credit is earned when the coach you referred begins genuinely using the App, not at the moment they enter your code. The app shows you which of your invites have been accepted and which have been confirmed. Until an invite is confirmed, no credit has been earned.

Referral credit has no cash value. It cannot be redeemed for cash, exchanged, refunded, transferred to another person or account, sold, or combined with any other account. It can only reduce the price of a paid subscription to the App, and only where the app store you purchased through supports applying it.

Credit applies to a future paid subscription. While the App is free to you, there is nothing for credit to reduce, and holding credit does not entitle you to a payment, a refund, or any other benefit.

We may change, suspend, or end the referral program at any time, for any reason, without notice. If we end it, we will still honor referral credit you had already earned, in the sense described above, before it ended, on the terms that applied when you earned it. Credit that had not yet been earned does not survive the program ending.

Credit must be earned honestly. Referring yourself, creating accounts you control in order to claim credit, exchanging codes with another coach so that both of you claim credit, or any other arrangement whose purpose is to generate credit rather than to bring a genuine new coach to the App, is a breach of these Terms. We may withhold, reduce, or reverse credit, and may suspend or terminate an account, where we reasonably believe this has happened.

Referral codes are for coaches who are new to Next Inning. A code cannot be used on an account that has been active for more than 30 days, and cannot be used on an account that has already used one. Credit reduces the price of a Coach Pro subscription only; it does not apply to add-ons, including additional teams.

The person you refer receives nothing under the program unless the app states otherwise at the time. We may review referrals before credit is applied and may withhold or reverse credit where the referral does not appear to be genuine. Any tax consequence of a discount you receive is yours.

Limitation of liability

To the maximum extent permitted by law, EMJAY747 Enterprises LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App is limited to the amount you paid us, if any, in the 12 months before the claim.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EMJAY747 Enterprises LLC from third-party claims, damages, and reasonable costs (including attorneys' fees) arising from the data you enter (including any player information you provided without the authority or permission described above), your misuse of the App, or your violation of these Terms.

App stores

You download the App from the Apple App Store or Google Play and may use it under a limited, non-transferable license, subject to the applicable store's terms and usage rules. This agreement is between you and EMJAY747 Enterprises LLC, not with Apple or Google. Apple and Google are not responsible for the App or its support; EMJAY747 Enterprises LLC is responsible for the App to the extent required by law. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

Changes

We may update these Terms. If we make a material change, we will notify you in the App or by email before it takes effect, and we will revise the date above. Continued use after changes means you accept the updated Terms.

Termination

You can stop using the App at any time and may delete your account from Settings. We may suspend or terminate accounts that violate these Terms or pose a risk to other users or the service. On termination, your data is handled as described in the Privacy Policy.

Governing law

These Terms are governed by the laws of the State where EMJAY747 Enterprises LLC is registered, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in that State.
